This privacy notice (“Privacy Notice”) describes how We, PT Senyum Rejeki Digital (“We”, “Us”, “Our” or “Senyum Rejeki”), obtain, collect, store, control, use, process, analyse, correct, update, display, publish, transfer, disclose, and protect Your Personal Data (as defined below). This Privacy Notice applies to all Users of Our Platform and/or Services.
By accepting this Privacy Notice, You acknowledge that You have read and understood this Privacy Notice and accepted all of its terms. In particular, You acknowledge, consent and agree that We may collect, process, and use the Personal Data and that such Personal Data shall only be used by Us or third parties acting under Our direction, pursuant to this Privacy Notice.
You may withdraw Your consent to the usage or disclosure of Your Personal Data at any time by notifying Us, in writing and at any time through reasonable means and time, using the details of contact stated below. You may also withdraw Your consent for Us or any of Our affiliates to send You certain communication and information, as already mentioned previously. By withdrawing Your consent, depending on the nature of which consent You retracted, several of the Services provided under this Platform may no longer be able to be used by You. Such withdrawal might also result in termination of Your account and contractual relationship with Us.
Upon receipt of such withdrawal notification, We will inform You the likely consequences of such withdrawal so You could decide if indeed You want to withdraw such consent.
Applicable Laws refers to applicable laws, by-laws, enactments, regulations, regulatory policies, ordinances, protocols, industry codes, regulatory permits, regulatory licenses or requirements of any court, tribunal or governmental, statutory, regulatory, judicial, administrative or supervisory authority or body, under the Republic of Indonesia;
Contact Data has its meaning ascribed to it in Section 2.b;
Device Data has its meaning ascribed to in Section 2.e;
Financial Data has its meaning ascribed to it in Section 2.c;
Identity Data has its meaning ascribed to it in Section 2.a;
Log and Location Data has its meaning ascribed to it in Section 2.f;
Members is the status of an individual being a member after purchasing or subscribing to Our Services, where they can utilise the exclusive discounts on offer and manage all their payments and update details as needed. Members are also automatically entered into the Giveaway Contest as a Participant, as provided by Our Platform;
Membership means a prove of active or on-going subscription as a Member, which is paid through monthly direct debit, or through an upfront billing period of 1 (one), 3 (three) or 12 (twelve) months;
Payment Data has its meaning ascribed to it in Section 2.c;
Personal Data refers to any data about an identified or identifiable individual, individually or in combination with other information, either directly or indirectly, through electronic or non-electronic systems;
Post and Interaction refers to User-generated material that is shared or created on Our Services; this content usually takes the form of messages, comments, or other contributions, and it also includes User involvement and interactions with the content;
Privacy Notice means this Senyum Rejeki’s Privacy Notice;
Services or Service means any features and/or products that are available in Our Platform, including but not limited to, the exclusive discounts, and Giveaway Contests;
Technical Data has its meaning ascribed to it in Section 2.d;
Terms and Conditions means the Senyum Rejeki’s Terms and Conditions, which is an integral part of this Privacy Notice;
Third Party Contents are contents related to Our Services that was created or developed by a third party, such as the contents, information, services, products, and/or exclusive discounts provided on our Platform and/or Our Services;
Third Party Provider is an unaffiliated person, company, or entity that performs services for Our Services including retailers cooperating with Us, and electronic payment method providers for Our Services;
Users are individuals who uses Our Platform;
Verification Mail are message that will be sent to Your e-mail to verify Your account registration;
Platform refers to Our website https://senyumrejeki.com and our application organized by Us to deliver Our Services for Users and/or Members;
We, Us, Our, or Senyum Rejeki means us, PT Senyum Rejeki Digital who organized and operates this Platform and/or Services;
You”, “Yours”, “Yourself”, or “Users means you, an individual using Our Platform, and/or Member, and/or Participant.
We collect Personal Data that identifies or can be used to identify, contact, or locate the person or entity or device to whom that information pertains, in accordance with Applicable Laws. The types of Personal Data that We collect depends on the circumstances of collection and on the nature of the service requested or transaction undertaken.
The Personal Data We collected are grouped as follows:
Includes full name (“Identity Data”).
Includes phone number, e-mail address and other addresses (“Contact Data”).
You may need to provide payment information, such as details of bank accounts and payment cards such as the type of card or payment account used, the name of the issuer of the card or payment account, the name of the holder of the card or payment account, the identification number of the account or payment card, the verification code of the payment card or account, and the expiration date such payment card or account, as applicable, virtual account data and financial history (including but not limited to payment card or account transaction history, payment card or account details, CVV code and mapping and/or status and condition of the payment card or account) (“Financial Data”). We do not store such Financial Data entered on Our Services. This information is stored by a third-party payment provider (included as a Third Party Provider as stipulated in Terms and Conditions), and the use and storage of this information will be subject to the payment provider’s own terms and conditions and privacy policy. If You do not wish to provide such Financial and Payment Data, You will not be able to and may not use certain Services on Our Platform.
Payment data includes details of payments or transfers made by Users on Our Platform and/or Services, including but not limited to data relating to usage, payments, recipient details (including their account details), payment methods used, payment amounts paid, billing details, and details invoice (“Payment Data”).
The details on Your usage of Our Platform and/or Services, such as identification generated by the Platform/Services (user id), internet protocol (IP) address, data as web pages previously or subsequently viewed, duration of every visit/session, the internet device identity (ID) or media access control address, mobile advertising ID and other device information including information regarding the manufacturer, model, and operating system of the device You use to access the Platform and/or Services and crash logs (“Technical Data”).
Information on the device You use to access Our Platform and/or Services, including the hardware model, operating system and version, unique device identifier, phone number, international mobile equipment identity (IMEI) and mobile network information (“Device Data”).
Includes Your browser type and language, access times, pages viewed, Your IP address and the Platform You visited before navigating to Our Platform, and real-time geo-location data (“Log and Location Data”).
While interacting with other Users on the forum/interactive area of the Platform and/or Services, You share Your contact information; the messages which You share are not private and can be viewed by any Members and/or Users.
The advertisements and related material that You post on the Platform and the information which You share therein are collected by Us (“Post and Interaction”).
By signing up an account and subscribed a Membership, We collect Identity Data, and Contact Data. Financial and Payment Data are also obtained when You make payments to subscribe a Membership, however, We do not store any Financial Data.
Technical Data, Device Data, Log and Location Data, and possibly Post and Interaction are obtained whenever You use and/or visit Our Platform and/or Services.
We may also collect Your Personal Data from third parties (including Our Third Party Provider and any others who provide services to Us, who collect Your Personal Data and/or perform functions on Our behalf, or whom We collaborate with). In such condition, We will only collect Your Personal Data for or in connection with the purposes for which such third parties are engaged or the purposes of Our collaboration with such third parties (as the case may be) (i.e. Your Payment Data from Our Third Party Provider which is an electronic payment method provider).
We may use Personal Data collected for any of the following purposes as well as such other purposes that are permitted by the Applicable Laws:
We will use reasonable efforts and care to ensure Your Personal Data is secure and protected against all threats, including access, collection usage or disclosure of Your Personal Data by unauthorized parties and against unlawful processing, accidental loss, destruction, damages and other similar risks. Your Personal Data may be retained and held by Us for as long as We deemed necessary to fulfil the purpose for which such Personal Data is collected for, or for as long as such retention is required by the Applicable Laws. We reserve the right to refuse Your request to access and/or the correction of Your Personal Data, both in part and whole of Your Personal Data, as permitted under the Applicable Laws. This may include circumstances where the Personal Data may contain references to other individuals or where the request for access or request to correct is for reasons which We reasonably consider to be trivial, frivolous, or vexatious. Subject to Applicable Laws, We reserves the right to charge an administrative fee for any access and/or correction requests.
We reserve the right to amend this Privacy Notice from time to time, at Our own discretion, to ensure that the Privacy Notice is consistent with the future developments of technology and or future development of regulation and legal requirements. Should We make any changes towards this Privacy Notice in the future, We will inform You in a timely and reasonable manner to You, such as through notice published on Our Platform, Your e-mail address, or any other reasonable manners that We can inform You regarding such changes.
The Privacy Notice constitutes a part of the Terms and Conditions. We have taken utmost care to avoid any inconsistency or conflict of this Privacy Notice with any other terms, agreements or guidelines available on Our Platform and/or Services. In case there exists a conflict, We requests You to kindly contact Us for the final provision and interpretation.
Governing Law and Disputes of the Terms and Conditions shall apply mutatis mutandis to this Privacy Notice.
